Terms And Conditions Governing The Use of The Advance Plus Loyalty Card

The use of the Advance Plus Card is subject at all times to the following Terms and Conditions

  • The following words and expressions shall have the following meaning respectively assigned to them:-
    • Card means the Advance Plus Card issued by RSC or such other card bearing the Advance Plus mark issued by any third party which has been authorized by RSC to use the Advance Plus mark.
    • Card Account means the Card account opened and maintained in the name of the Cardmember by RSC in its computer where the Cardmember's purchases, rewards and redemptions made at the Merchants, the Rewards are recorded and updated.
    • RSC means Rewardstreet.Com (Malaysia) Sdn Bhd (Company No.380214-P), a Company incorporated in Malaysia and having its office at Level 1, East Wing, Wisma Synergy, No.72 Pesiaran Jubli Perak, Seksyen 22, 40000 Shah Alam, Selangor and includes persons deriving title there under and its successors in title and assigns.
    • Cardmember means any person issued with the Card in accordance to the Terms and Conditions set forth herein.
    • Merchant means the establishment which has a valid and subsisting agreement with RSC to participate in the Program to grant Rewards to Cardmember who purchase and/or redeem goods and services from it, subject to the restrictions, exclusions and/or conditions as may be communicated to the Cardmember at the time of effecting any purchases of goods and/or services.
    • Rewards means the rewards granted by the Merchant to the Cardmember based on the gross amount of purchases and/or redemption when the Cardmember presents the Card upon making payment for such purchases and/or redemption of goods and/or services from that Merchant.
    • Program means the Advance Plus Loyalty Card Program operated and managed by RSC.
    • Rewards Slip means any transaction slip or document as evidence of the Rewards granted by the Merchant to the Cardmember.
    • Redemption Slip means any transaction slip or document as evidence of the redemption made by the Cardmember at the Merchant.
    • Website means the website owned and operated by RSC in relation to the Program.
    • Cardmember Rewards Entitlement means the Rewards granted by the Merchant to the Cardmember after RSC using the portion of the Cardmember Rewards according to 7. c).
  • In consideration of RSC making available facilities of the Card to the Cardmember, the Cardmember shall pay the Joining Fee unless any such fee is waived or paid by a third party.
  • In consideration of RSC renewing the Card on the anniversary date of the Card, the Cardmember agrees to permit RSC to deduct the credit from the Card Account at an amount equivalent to Ringgit Malaysia Ten Only (RM10.00) per year upon each subsequent renewal or such rate as may be varied by RSC from time to time for the subsequent years' Annual Fees. Should there be any insufficient credit in the Card Account to settle the Annual Fees, RSC shall have the absolute discretion to cancel the Card Account at any time thereafter, with or without any notice given to the Cardmember.
  • Provided always that the Cardmember has duly complied with these Terms and Conditions:-
    • Card is valid for obtaining Rewards at the Merchant by the Cardmember for as long the Card is remained active from the date of issuance of the Card.
    • RSC may at the Cardmember's request, replace a Card that is declared to be lost or otherwise damaged subject to RSC receipt of a card replacement fee of Ringgit Malaysia Ten (RM10.00) or of such other amount as may be stipulated by RSC from time to time. RSC is not responsible for any loss rewards stored in the Card.
  • The Card is not a credit card, debit card or charge card and it cannot be used for payment, nor is it a discount card and the Cardmember shall not use it to negotiate or obtain discount or other privileges from any Merchant.
  • The Cardmember shall present the Card to the Merchant upon payment for purchases made to obtain Rewards subject to the Merchant obtaining an approval code from RSC and to the other Terms and Conditions as contained herein.
  • In consideration of the Cardmember assigning to RSC, absolutely the rights to receive Rewards from the respective Merchant and subject always to Terms and Conditions contained herein, RSC at the request of the Cardmember agrees as follows:-
    • to grant the Cardmember the Rewards when the Rewards are fully collected by RSC from the Merchant.
    • to accept the authorizations given by the Cardmember and/or Merchant in the Rewards Slip to credit the Rewards to the Card Account provided always that the Reward Slip has been duly executed by the Merchant and the Cardmember.
    • Assigning to RSC absolutely the right to use the portion of the Cardmember Rewards for administration costs, lucky draws, charity contributions, advertisements, incentive for merchant’s staff and merchant.
  •  
    • Rewards obtained by the Cardmember are transferable or assignable subject to Cardmember written request to RSC.
    • No cash refund on Rewards obtained by the Cardmember.
    • Rewards expire 36 months after issuance on a first out basis.
  • Rewards will be granted at the rate agreed between RSC and Merchant when a Cardmember purchases or redemption on goods or services at Merchant's outlets. RSC may alter the rate at which Rewards are granted at RSC discretion from time to time.
  • The payment for purchases made by the Cardmember may be in the form of cash, credit cards or any other instruments acceptable to the Merchant.
  • In addition to deductions from the Card Account in payment for the Membership Annual Fees, Card replacement fees and other fees as may be charged by RSC from time to time, RSC will deduct from the Card Account any payment made to the Cardmember in respect of the Rewards, credited in error and/or any Rewards relating to a transaction which is cancelled or reversed or where a refund is given.
  •  
    • RSC shall inform the Cardmember the purchases and redemption made at the Merchant, the Rewards granted by Merchant, the fees amounts and/or charges and/or adjustments debited to his/her Card Account by means of a electronic statement issued on a periodical basis quarterly or at such other period as may be decided by RSC.
    • Rewards may be accumulated and with sufficient Rewards the Cardmember is eligible to redeem at participating Merchant using the redemption methods implemented by RSC.
    • Rewards will also be granted at Rewards rate agreed between RSC and Merchant when a Cardmember redeems his/her Rewards at Merchant's outlet.
    • Redemption of part or all the Rewards accumulated by a Cardmember is subject the Cardmember complying with the procedure and may be made by combination of Rewards plus cash or any other form of payment acceptable to the Merchant.
    • Rewards cannot be redeemed until they are credited into Cardmember's Card Account. Rewards will only be recorded in the Cardmember's Card Account only after the Merchant has done the settlement at the end of the day.
    • The Cardmember hereby covenants with RSC that:-
      • the statement issued by RSC shall be final and conclusive evidence against the Cardmember in any legal proceedings and for all other purposes whatsoever.
      • the statement issued by RSC, as conclusive evidence of any claims by the Cardmember against RSC.
  • Any benefits which are provided free of charge to the Cardmember may at the absolute discretion of RSC be suspended or terminated with or without notice.
  • Rewards may be granted by the Merchant which display the Advance Plus signages, subject to the restrictions, exclusions or conditions as may be informed by the Merchants to the Cardmember at the point of interaction.
  • The Merchants may at their discretion not grant any Rewards for sales or promotional items or when the Card is presented together with any privilege or discount related vouchers and/or cards.
  • RSC shall not be liable to the Cardmember in any manner whatsoever for any of the goods and services purchased from any Merchant by the Cardmember with or without obtaining the Rewards through the use of the Card. Any dispute in relation to such purchase shall be dealt with directly between the Cardmember and the Merchant.
  • RSC shall only credit to the Cardmember the amount due in respect of Rewards (as the case may be) not obtained from the Merchant which displayed the Advance Plus signages, subject to satisfactory evidence being produced by the Cardmember of purchase of goods or services which qualify for the Rewards (as the case may be) from such Merchant.
  • RSC will only grant the Rewards to the Cardmember after an approval code is given by RSC to the Merchant in a manner acceptable to RSC.
  • RSC shall not grant the Cardmember, the Rewards (as the case may be) not granted by any Merchant, which has terminated its agreement with the RSC and has not displayed any Advance Plus signages even though its name may still be listed.
  • RSC shall not be liable to the Cardmember in any manner whatsoever for any benefits and/or privileges and/or services and/or facilities offered in conjunction with the Card but not offered by RSC and/or its Merchant and/or its contracted service provider and that any dispute or claim in relation to such benefits and/or privileges and/or services and/or facilities shall be dealt with directly between the Cardmember and the party (or parties) which offer(s) such benefits and/or privileges and/or services and/or facilities.
  • Any liability that RSC may have to a Cardmember, whether for negligence, breach of contract or otherwise, is limited in the case of any claim relating to the Rewards to crediting such Rewards to the Cardmember's Card Account.
  • RSC reserves the absolute right to add, delete or amend the Terms and Conditions at any time and prior written notice of the same shall be given to the Cardmember in the form and manner as determined by the RSC including the giving of such notice to the organization(s) which has/have sponsored the issuance of the Card to the Cardmember. If the Cardmember does not accept any variation and/or addition to these Terms and Conditions as notified to him/her from time to time, the Cardmember may terminate the Card by written notice to the RSC accompanied by the return of the Card cut in half. If the Cardmember uses the Card after the effective date of any variation and/or addition to these Terms and Conditions, the Cardmember shall be deemed to have completely accepted and shall be fully bound by such variations and/or additions.
  • No waiver by RSC of any fees or of any other rights shall operate as a waiver by RSC of its rights to subsequently insist on full compliance by the Cardmember of the same provision or of any other obligations on the part of the Cardmember.
  • The conditions stipulated in any of the communication literature shall form an essential part of the contract between RSC and the Cardmember and are deemed to be incorporated herein. However, in the event of any discrepancy or inconsistency between the conditions set out in any of the communication literature and these Terms and Conditions or between the condition set out in any of the communication literature and the conditions notified to the Cardmember by the Merchant at the time of any transaction, then the provisions of these Terms and Conditions or the conditions specified by the Merchant (as the case may be) shall prevail.
  • In the event of any dispute between the Cardmember and RSC, the Cardmember agrees that such dispute shall be referred to the arbitration by RSC, and that the decision of such arbitrator shall be final and binding on both parties.
  • The Advance Plus signages displayed on any premises of Merchants shall not be taken as a warranty by RSC that all goods and services available at the premises shall be subjected to the Rewards.
  • The Card which is issued by RSC or the name of the company as appear on the front of the Card remains the property of the issuer and the issuer shall be entitled to full recourse against any indemnification by the Cardmember in respect of any breach by the Cardmember of any of the Cardmember's covenants obligations and warranties herein and improper use of the Card for which RSC or the issuer has incurred or sustained any cost loss or damage and for any costs incurred by RSC in enforcing these terms and conditions (including all legal costs on a solicitor-client basis).
  • These Terms and Conditions are governed by the laws of Malaysia.
  • These Terms and Conditions are subject to change from time to time at the discretion of RSC.
